You probably need this more than you think
Most people who sit down with me aren't wealthy. They own a home, they've got some savings and a retirement account, and they have people they care about. That's enough.
Here's the part that surprises people. If you own a home in California and you don't have a living trust, your family will most likely end up in probate court after you die. Not because you did anything wrong. That's just how California works. Probate is slow, it's public, and it costs money that could have gone to your family instead.
An estate plan is how you keep them out of it.
Do I need a will or a trust?
Short answer: a will tells the court what you want. A trust keeps your family out of court.
A will still has to go through probate in California in most cases. A living trust, funded properly, does not. For most homeowners in the valley, that one difference is the whole reason to do this.
That said, a trust isn't automatically right for everyone. It depends on what you own and how it's titled. We'll go through that together before you commit to anything.
What's in a complete plan
Revocable Living Trust
Keeps your home and assets out of probate, keeps your affairs private, and sets clear terms for how everything passes to the people you choose.
Pour-Over Will
The backstop. Catches anything that didn't make it into the trust and directs it there.
Durable Power of Attorney
Names who handles your finances and legal affairs if you can't, so your family isn't waiting on a court to appoint someone.
Advance Health Care Directive
Your medical wishes in writing, and the person you trust to speak for you.
Guardian Nominations
If you have minor children, names who raises them and provides a legally sound backstop alongside your trust.
Trust Funding
The step people skip, and the one that matters. A trust with nothing in it does nothing. We prepare the deed that moves your home into the trust and walk you through the rest of your accounts.
